    Ok so I think I was wrongfully jailed this weekend. I know I made a mistake by riding with someone that had been drinking, but it was my only ride. Long story short my buddy got pulled over, and taken in for DWI. After the officer was done with my friend he came to me and asked me to step out of the car, I told him I thought it would be better if I didn't since I had a few drinks that night as well. The officer stated it was fine he just wanted to ask me some questions. Me being co-operative with the officer I step out of the vehicle. Not even 2 seconds later BAM out comes the flash light and trusty pen for a sobriety test. I asked him if this was nessecary and informed him that I was already waiting on a ride. The officer stated that he was liable to make sure I was not going to be a danger to the public before he could release me. I told him this is wrong and went ahead and took the test...then of course you know what came next, "turn around and put your hands on the vehicle". I guess I am directing this question to the officers on the board, but in your opnion, if I was ever in this situation again, what would be my best way to handle things without being trouble to the officer and NOT have to take a ride to the station? Before anyone says anything about RESPECT, I have much for any officer I come in contact with, seeing as I myself have set a goal to become a part of the police force someday.

    Dont think you can do much more. The cop can either wait for your ride to show up or take you downtown like he did.

      Lawyer up and pay to fight it or pay the fine and move on... your choice.

            Well, he couldnt release you with the vehicle if you werent sober but the asshole could have allowed you to call someone to come get you. I guess he just didnt want to wait around for your ride to show. Matt would have just given you a ride home and then taken the idiot drunk driver to jail.

              He was going to impound the vehicle as a result of the arrest. You were then publically intoxicated. Legal? Yes. Chickenshit? Possibly. Officer's discretion? Definately.

              I would have to be there to make the call, honestly, but he might not have been able to wait to see if you got a ride. Say he let you go to wait for your ride as he went to book in the DWI fucktard. Your drunk ass then stumbles around beside the road and steps into oncoming traffic. BAM! He's liable.

                Damn that sucks! My brother is a Police officer and I am going to ask him. I am curious what he would have done in this situation.

                      He can't leave you with the vehicle, and he can't leave you on scene alone if you're intoxicated. I assume he couldn't wait for your ride to get there, so he arrested you for PI instead. It's a common thing.

                        Why not take him with him to the jail, but not actually arrest him. Let him get to the station to call a ride?
