    Looks like the ATF is on the move. Article is linking the fact Dorner had NFA items owned by a Trust. Of course they left off the facts like a) when he bought the items, was a LEO at the time and a signature would have came anyway? b) he would have passed any background check they gave him.

    Then they talk about people using a Trust to "pass down his or her weapons to family members in a responsible way". We wouldn't have to do that if we didn't think that the .gov was trying to out law possession, and private sales i.e. when the person that buys a firearm dies that particular weapon can not be owned by anyone else.

    The concern among gun enthusiasts that certain types of guns could be outlawed or further restricted in the future has led some to seek out gun trusts.     The New York Times reports that gun trusts are intended to allow the owner of a firearm to pass down his or her weapons to family members in a responsible way. But a loophole in the federal law has other benefits, some of them potentially troubling to gun control advocates.

    The Times explains that when trust members buy "restricted firearms through a trust," they are exempt from rules that would apply to individual buyers. Things like "being fingerprinted, obtaining the approval of a chief local law enforcement officer and undergoing a background check" are not required.

    Christopher Dorner, the former Los Angeles police officer who went on a killing spree before being killed in a cabin in Southern California, used a gun trust to obtain silencers and a shotgun. The Times notes that Dorner was not a felon at the time of his acquiring the weapons and would have likely passed a background check.

    Mike Campbell, a spokesman with the Bureau of Alcohol, Tobacco, and Firearms told the Times that his agency is aware of the loophole. The ATF is "reviewing changes to close it, " he told the paper.

      FWIW, the ATF was supposed to already be reviewing changing the CLEO approval portion to CLEO notification, so they could do away with trusts. If you already have one, it will most likely be grandfathered, just like every other change in gun laws has been.

        I would still rather my investments such as NFA items be in a Trust to further sheild me from liability.

              It will take amending the NFA of 1934 to make trusts invalid or another congressional bill. ATF cant just say sorry no more. At least that's my take.

              I also hate teh term loophole. Just because its a different way, not common to everyone else, or not expressly written; isnt a fucking loophole.

                They deemed a shoe lace as a machine gun part and sold guns to mexican gangs.
                They pretty much do what they want.

                  Would it be a good idea to set up a trust? I've acquiring more AR parts and thinking a SBR is on the way and some suppressors, etc.

                      You can interpret laws and meanings to clarify a definition and all can be challenged in a court of law.

                      NFA of 1934 says you can have a trust. They can interpret it however they want, but they can't get rid of it.

                              Interested in knowing how long it takes the BATFE to cash your check. SA mailed mine mid January and nothing yet, but they also mailed a friend of mine's stuff early this month and his check has already been cashed..
