The government writes the laws and logic has nothing to do with it. Get caught with a NFA anything that they do not know about and you go to prison for failure to pay the 200 dollar tax on that item. The NFA paper work exsist for the government to collect the tax, and for you to prove that the tax has been paid. It is a BS system designed to make you not want to own any NFA weapons by being expensive and a pain in the ass. You can read the transcript from congress debating passing the NFA if you are interested in learning what it is really about.

Under that theory, there would be many thousands more of machine guns in households. Seems to me you’d have an automatic defense to prosecution for attempt to pay the govt but they refuse and their refusal could not lead to charge against you...but you don’t because it doesn’t exist.

This. Heck, bump firing with the pant loop or doing a rubber band trick. How would that rate?

That is what I was suggesting someone with some big nuts try. You should be the first test case since you do not believe the law as it is written even when I have tried to explain it to you in very clear terms.

Edit: There are more machine guns in the USA that are not on paper then are on paper and that is not my opinion, that is the opinion of the ATF. They do not worry about it and only do anything about it if they are found in conjunction with another crime or if they are being trafficked/sold. Until DHS was formed the ATF was not even considered an agency with LE powers. They were just a regulatory agency that collected taxes on the 3 things that are in their name. If you are familiar with the structure of Federal Law Enforcement it makes all of the BS that the ATF has pulled in the past all the more shocking since they completely lacked the authority to do any of what they did.

That is not what happened at all. A SOT put a shoe string on a form 1 as a machine gun when attached to a M1 and paid the 200 dollar tax just to make a point. The law as it is written says that the parts to make a gun full auto are in themselves a machine gun the same way a rubber wipe is by itself a suppressor.

No thanks. Already know if a individual in jail on possession of illegal silencer and it’s not because he didn’t pay a tax.

And to clarify my point of being in a household, publicly mention and acknowledge with no repercussion.

Actually that’s not how it happened at all. A letter was sent to the ATF FTB and they issued a ruling letter. SOTs will typically never do Form 1s. Especially for resale.

What ever form an SOT fills out when they make a machine gun. On the firearmblog some 6 or so years ago there was an article about an SOT that did what I am describing to make a point.

Here is the transcript from the Congressional hearing when it got passed. Please take note that they call it a tax bill about 100 millions times.

I’m just a bill. Yes, I’m only a bill. And I’m sitting here on Capitol Hill. Well, it’s along, long journey To the capital city. It’s a long, long wait While I’m sitting in committee, But I know I’ll be a law someday At least I hope and pray that I will,
But today I am still just a bill.

I’m just a bill Yes I’m only a bill, And I got as far as Capitol Hill. Well, now I’m stuck in committee And I’ll sit here and wait While a few key Congressmen discuss and debate Whether they should let me be a law.
How I hope and pray that they will, But today I am still just a bill. I’m just a bill
Yes, I’m only a bill And if they vote for me on Capitol Hill
Well, then I’m off to the White House Where I’ll wait in a line With a lot of other bills For the president to sign And if he signs me, then I’ll be a law How I hope and pray that he will, But today I am still just a bill.

But how I hope and I pray that I will, But today I am still just a bill.
