HOUSTON (FOX 26) -
A woman shot and killed a man with a rifle and didn't wait for the police before driving away from the scene. Now
the victim's family wants to know why the shooter is free tonight.
The whole incident was caught on tape and according to witnesses it stems from a heated argument between A 23 year old woman and
58 year old male. It's possible she was acting in self-defense but until a grand jury can see all the evidence and hear from
each side she hasn't been charged with anything.
"He was a loving person, he loved his family" with tears in his eyes, Glenn Walker admits he's reliving last night over, and over.
"I saw my uncle laying on the ground" said Walker. Shot multiple times and caught on tape, police say, Lewis Daniel made "sexual advances"
towards a woman seen in surveillance video. The woman was pumping gas but things quickly escalated when police say the harassment
continued. In the video you can see the woman pulls out a rifle from the trunk of her care she allegedly fires a warning shot then
fires again after Daniel lunged at her with a knife. "She had the chance to drive away, she got in the car, got out, popped the trunk and
pulled out the gun and shot him...is that self-defense?" asks Walker, the victims nephew.
Whether or not it was self -defense is up to a grand jury since the woman hasn't been charged with a crime even though she's seen
driving away from the scene. Legal expert Edwin Walker explains how police will continue to gather
statements and all evidence for a jury to decide what's next.
It's quite possible she could be protected by the "no duty to retreat law" it's similar to Florida's
"Stand your ground law," "It just simply means that it cannot be used as evidence that a person did not retreat prior to using deadly
force in a self-defense situation" says Walker. And self-defense can only be considered when the person feels imminent danger of death
or serious bodily injury. That too will be determined by the grand jury and they'll begin by reviewing the security video.
"Determining why she acted so nonchalantly , continued to pump gas , why she took a picture of him and
why she drove off without calling the police or without waiting for the police to arrive" are just some of the tough questions the grand
jury will be asking before we know what if any charged will be filed. Meanwhile Lewis' family mourns and hopes for more answers into
what exactly was said that could've caused such a tragedy.
