Where you'll get tripped up is under the definition of "secured".
(4) "Secured," in connection with use of a safety belt, means using the lap belt and any shoulder straps according to the instructions of:
(A) the manufacturer of the vehicle, if the safety belt is original equipment; or
(B) the manufacturer of the safety belt, if the safety belt has been added to the vehicle.

The argument will be that you should be familiar with your vehicles owner's manual. And that if you bought it used, then you should have known, or that a reasonable person would have somehow acquired the owner's manual. Why the hell would you put it under your left arm anyhow? Law states u shall wear the seat belt per manufacturers specifications. That's where the shoulder belt is suppose to be over ur shoulder. I can't stand those tickets... I'll do the blatant no seat belt tickets and u lie about it. I'm not stopping the little teeny hopper and old lady who doesn't have the shoulder strap over their shoulder... I gots better things to do!

There is a specific exemption for older cars that only have lap belts. The catch? If somebody went back and added the shoulder belt, then it has to be worn.
