Actually, I have the same question about this as was raised about the law that says an officer can stop for the sole purpose to determined if the driver has a licence to operate a motor vehicle.
Why don't you research this and see if there is any case law against that statute?

Oh, and there was no judge involved, just a Municipal Court Prosecutor, which FYI, is the lowest prosecutor on the totem pole. They prosecute Class C misdomeanors, which is the lowest offense that exists.
So, it's not like I consulted a Supreme Court justice on that.

I've noticed the police have a strong tendency to use the "law" how they like at the time. Its really up to them. They can pretty much take you to jail for anything, if there actually was some sort of situation. Even if you technically didn't break the law. Whether or not the charges will stick is a totally different story, but you certainly can't count on the police to know they law. There will always be more than one way to skin a cat. Instead of enforcing that statute, an officer, or FD Arson Investigator could always cash bond someone (custodial arrest) for creating an open/uncontrolled burn. That's about a $1,000 ticket you'd have to post a bond for before getting out of jail.
