The President can sign any treaty he so desires, it's up to congress to ignore what he says unless proper channels are gone through. It's congress' fault that the ratification process isn't being adhered to.

Four years ago I may have agreed with you, except this president has already done several things that completely circumvent Congress. It is hard to blame Congress when the president has proved he can and will bypass them if he deems it necessary.
