OK another question. If I'm just using Safari and email when I tether would I still be caught? It's the same app on either my iPhone or iPad so I figured they can't tell the difference like if I'm using an iPad specific app.

 If you're tethering the old iPhone way, it'll still go through the APN for iPhone tethering so they'd know.
