Phone does not currently have service. Went to a local T-Mobile store to verify the phone is good to use and they said its fine with no holds on the ESN or IMEI but told me they can only sim unlock it for the original account holder from when it was new...that I find to be bullshit.

I just talked to my buddy who works at T-Mobile, he said what you were told is true and they keep that shit on lock down. There are some 3rd party sites that might unlock it but he said as of January 2013 it's illegal, but that never stopped anyone.
