    • So a guy found an mp40 and sten gun while doing demo on a old house in San Diego. The guns look like they are in working condition.

        • I'd bet that this happens more than people ever know. I've been called out to look at a fair share of machine guns found in a house. Some I've cut, some have been donated, others who knows.

          • What are your options when you find them like this?

I've always looked for paperwork with the family. If no paperwork found, I call a few folks I know who work for the ATF. If they find nothing I tell the family they legally have 2 choices. Destruction or turn it in to a LE agency or see if a museum wants it. Maybe get a contract that if amnesty they can have the gun returned back to them after registration. How they choose to handle it from there is up to them. Most take the money they get out of parts kits.

Some say bring back paper work should count as registration paperwork. But I've never had that accomplished. Though rumors of other that have.

I remember us talking about this particular topic a while back. I had to share a bit of a story I heard from a family friend who knew my step father.

My step father (no longer around) was in Vietnam for a couple years. He claims that one of his buddies brought back the receiver and guts to 3 full auto AKs... stripped them down and shipped them home. *Supposedly*, they were reassembled during the 70s and were quite functional and fun.

What is the legality of that if they happened to turn up and were never registered? Would that also be a situation of "destroy or donate"?

                    Yup. Couldn't legally keep them.

                      • $100,000 fine, 10 years in prison, and no guns ever again. Back in those days it would have been a little expensive to register those as machineguns, completely legal to do it, $200 for each gun. But at the time, $200 would get you a brand new AK in full auto. Back then a lot of people were discouraged by the fee (that was the whole point of it, cost of a new Thompson back in the 20's). If that fee was adjusted to today's money it would be $3,500 dollars per transfer. Nowadays we scoff at the fee because inflation as caught up with it. I wouldn't surprised with they try to bump it to $1,000.

No, sorry, I should have quoted. I was referring to the existence of that piece (KAK Industries Sig brace buffer tube).

You say that, but i just talked to a guy this past weekend that went to prison because of illegal firearms/suppressors/etc. and when his probation his up he is allowed to handle and own firearms.

My aunt went to prison for 2 years for a SBS...she can still own guns, hunt, etc.

Just quoting the maximum federal sentence. State laws allow felons to regain those rights if they choose. On a federal level though, you're banned if I'm not mistaken.

I'm curious when the maximum is enforced. This fellow this past weekend was pretty much a gun runner. Fly to certain countries, buy machine guns, suppressors, mags, ammo(this was during the Clinton era), ship them to south Africa, take said items apart and ship in different boxes to the states.

He got caught because of some pothead he was selling machine guns too ratted him out.
