Can they just pull you over for leaving a bar? Don't they need probable cause for making a traffic stop... like not using a blinker, wide turn, etc? I don't drink or go to bars, just wondering. Seems like this would make for bad business for a local bar owner.

You can't be pulled over just for leaving a bar - but that is a good indicator you may have been drinking, and many cops will follow you until you make a minor mistake to pull you over and find out for sure, and they may take a chance and pull you over even if you don't screw up.

At 2am, there's a very good chance someone leaving the bar has been drinking. Even if you were driving perfect and got pulled over, you would have a hard time proving in court that you used your blinker, or didn't drift slightly over a line on the street for a moment, and there was no reason to stop you... especially if you fall on your face on camera during the alcoholic olympics, or blow a really good GPA on the breathalyzer.

He's right though, its more of a revenue generating tactic. If it wasn't the punishment would be harsh. Like in Norway, fines are based on your income and you get to visit norweigan bighouse for awhile.

Hence why you "regretfully decline all of the above" You'll go to jail either way but its harder for them to prove.

I've worked a double shift, got pulled over on my way home, and the cop wanted to hit me with DUI, simply because i looked as tired as i felt.

Some cops are great, some are assholes. Hope for the great ones, but be prepared for the assholes.

That's how Arlington shuts down the bars they don't want. For some reason they don't pull that trick at Cowboys or Sherlocks any more.

When did they stop doing this at Sherlocks? It wasn't long ago that they would mark tires with chalk to gauge how long you'd been there, and they love to pull people over who pull out onto Southbound Collins and bust that first U-turn to go Northbound or to get to 30. The "No U-turn" sign is before the turn-out, so you wouldn't even know that you're not supposed to do one. They are crafty, indeed. Hell, there were times that they'd have 2-3 cops walking around in there, eyeballing folks. I was buds with one of the bartenders and he hated that shit.

What about court fines, cost paid to the state for breathalyzers. ETC ETC ETC. Where do you think all of this goes? Back into the city to help pay for stuff. I've never had one thank God but I know they're expensive. Traffic infractions when you fight them nickle and dime you to death.

DWI surcharge is paid to the State of Texas. So I guess it would make more sense if it was DPS sitting outside the bar for it to be a revenue generator for them. If anything the city probably loses money on a DWI. It takes alot of time and resources to work them, also a good amount of paperwork.

I was in missouri a few weeks ago and I saw road workers and a select few had big black letters on their orange vest " I got a dui" in so and so county. That gave me a good laugh.

I just got off the phone with a prosecutor and here's the scoop:

1st offense DWI with no aggravating factors:

90 days in jail probated to 2 years
DWI education
24 hours of community service
Fine $550-650 (money goes to county)
if the person had a BAC of .15 or over, they are required to get an interlock.


So, how much does the PD make?

None.

So, that kind of blows your "revenue generating" theory out of the water.
