A person cannot be booked for DUI based solely on the FST? The officer doesnt have to allow you to prove your innocence by letting you to give blood or do a breathalyzer exam. It would then be your word against the State...and we all know how that ends up.

I guess I could have explained it better. Of the people that I have arrested and they provided a sample of their breath and or blood, I have yet to see one blow under .08.

It's not like the officer "allows" you to blow. It is always requested.

I know you know this, but for others, the request is part of the DWI paperwork from the state.

...Let's get realistic here, if you're truly not doing anything wrong(not impaired according to the sets laws in this State) you will pass through a DUI checkpoint without much more than 30 seconds of your time, if that much. You act like they stop every single vehicle and make each driver go through a full field sobriety test. I guess inconveniencing you for 30 seconds in order to help find and get drunk and impaired drivers off the road is completely and utterly unacceptable to you. Selfish much?

Since the thread started with the "no refusal" policy - If I go through a check point, completely sober, and refuse to blow - my car is going to be impounded, I'm going to be put in cuffs and carted off to the hospital for god knows how long, and then given a medical procedure against my will. Then, I'll need to find a ride home from the hospital, over to the impound lot, pay to get my car out, pray its not f'd up, then go to court if I'm interested in trying to recoup my impound fees.

That's pretty damn inconvenient if you ask me.
