I don't understand how you don't have a case against them? You made a purchase, you should have a receipt. You didn't receive the goods at the time of purchase and still haven't to this day. What exactly is on their side? They can't show up to court and say they already gave you the goods.

Small claims is for cash only, not for merchandise. Since they have a no cash refund policy and no official time limit on when they have to deliver the goods, there is nothing that the courts can do. Even if I did get the ruling, which I wont, he doesn't have to pay it anyway.

Not a whole hell of a lot I can do. I am not going to do anything illegal over $1000. Court is useless because the law is on his side. I suppose I could go up there every day and be a pain in the ass, but that is just going to cost me more time and money. The only real thing I can do is try to warn other people and make him lose customers.
