Even in Texas the situation doesn't warrant using deadly force, the guy found a phone and kept it, he didn't force entry anywhere, or even pick-pocket. Factor in that the owner of the phone lured him over under false pretense, and introducing a firearm would cause all sorts of grief if the "perp" freaked out and called the cops.
Don't get me wrong, the guy is a scumbag for keeping the phone that he found, but he isn't some dangerous criminal. All of this gun talk is laughable.
