Landlords - need help with EVICTION process please....

      First thing I would do is hot box it. Have an a/c guy go over and service the system by pulling all the refrigerant out. Hell, have him take the compressor too.

          I Owned a few rental properties so have a little advice: never ever dick around and wait, stop being nice. When a tenant owes you money, after a week or so, you file eviction, all there is to it. Every time you're nice, they will take advatage of you, guarantee it. If you have a tenant for a few years and one month they say they'll be a week or so behind, no problem, new tenant that after the first few months starts to fall behind, that's a no go.

          What I would do is tell them that if rent was not received by day seven there was a late fee and if rent had not been received there was a notice to vacate. Stress that a lot and make it very clear before they sign the lease and have it in the lease so there are no surprises.

          If you have to evict, you have to file at the sub courthouse the rental properties is located in. Certain counties, such as Tarrant actually have a template from which a notice to vacate has to be constructed. Also, make sure you always send it via certified mail, never ever deliver. Delivered a NVT, got to court, we went before the judge, they said they never got a NTV and the case was thrown out because it was my word against theirs. Thus they got to live there another month free, it was bullshit. Always send certified mail, may take an extra day or two, but it sure beats a whole nother month. Once the NTV has been delivered they have X amount of days to vacate. After that then you go to the sub courthouse and file. They will be served, then it's court time. Bring your lease contract and any other paperwork you think may be pertinent to the case.

          Always stay on top of tenants and make sure you do house inspections every few months. The moment you lax up a little or get lazy, you lose money

          And never ever change the locks, hot box the house, cut services, harass them, etc. Tenants have far far more rights than landlords. You start doing that and the repercussions are far worse than eating it and taking your time to do it right. No matter how mad you get, and you will at times get furious, make sure you follow the rules and laws to a T.

                I don't have any real input to add to this. My father is an attorney so a letter certified sent to them on a letter head usually has them out in a couple days of receipt. So our evictions on our houses are pretty painless.

                  Go over and pull the electrical meter off the base as an alternative to the hot box method that Al described. If you do anything to the a/c they will just put in window units.

                    This is a hilarious solution. Although knowing Chris' luck one of the kids would stroke out and die from the heat and he'd end up being charged with manslaughter.

                      Hot box is a good one, also you could probably have the city shut off the water. If that fails, there are plenty of other ways that you, as the property owner, have to make them staying there anything less than uncomfortable.

                          Also why I use a Management company to find my tenants. You should get to keep the deposit for back rent if nothing else. Either way you will be out some money.

                              How does a certified letter work? I mean don't they have to sign for it? What happens if they never answer the door, deny identity, or refuse to sign for it?

                              Also, I am fairly certain you cannot shut off essentials like utilities or disassemble climate controls. I think by law you cannot rent out a house without heat and ac. You need to read up more on that before getting yourself in trouble.

                                At some point is seems you should be able to have them removed by the police. What does it say in the rental agreement about this?
