I guess he could be going on that burglarizing on unoccupied vehicle is a mr meaner. I'd say either relate to "criminal mischief during nighttime" which allows the use of force. I thought I read of a situation where a thief attempted to steal a car at a carwash while the owner was getting change. Owner shot and killed thief and was not charged. This was like 15 years ago I believe.
