Just hope the commission of the theft occurred at night time...
Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

I don't think so, but hard to say. I think generally it is abuse of power, f'ing with people on their property without need and making mistakes that have no consequences - unlike a civilian. To my knowledge I have not heard anything about the guy displaying a weapon....that doesn't mean he didn't. I figured if he had...it would have been all over the article. I just keep thinking back to all the times kids or college kids I've known have done late night "beer runs" at various grocery stores and how people would react if some 17 or 18 year old white college kid were gunned down for trying to snatch a 12 pack of beer by the local store owner. I don't think the death penalty would come up but a police officer is trained to know the difference between a misdemeanor theft charge and attempted murder. I agree in shooting the guy! Just not killing him. I think the law needs to be changed shoot to kill only if your life is in danger. A simple shot to the leg would have sufficed!GOD BLESS TEXAS
