Sec. 46.04. UNLAWFUL POSSESSION OF FIREARM. (a) A person who has been convicted of a felony commits an offense if he possesses a firearm:
(1) after conviction and before the fifth anniversary of the person's release from confinement following conviction of the felony or the person's release from supervision under community supervision, parole, or mandatory supervision, whichever date is later; or
(2) after the period described by Subdivision (1), at any location other than the premises at which the person lives.I believe you guys are saying the same thing Brent...by "above stated term" he is likely referring to the 5yr term that was stated previously.Originally posted by bcoop View PostJust seems to me a person hired to enforce the law ought to know the laws they are enforcing. Apparently he does not. Which doesn't surprise me, given his track record of posts on here.

It really is a shame that a guy got killed over a few pot plants that are probably legal in other states.Originally posted by racrguyWhat's your beef with NPR, because their listeners are typically more informed than others?Originally posted by racrguyVoting is a constitutional right, overthrowing the government isn't.

I just here people say the convicted felon thing all the time. I believe this is where the confusion comes in.Originally posted by stevo View PostState law overrides federal law in this case.
EDIT: I was surprised to read the law, I was totally ignorant of that section. Learn something new every day.

You are probably right if you took a piss in your front lawn with kids playing outside, all while grabbing the paper.Originally posted by bucky View PostWho in the hell can keep up with all the laws now? I probably broke 10 this morning taking a piss and walking outside to get the paper.

You must not know guns bro! There are loads of DA/SA semi-autos out there. Ass loads!Originally posted by Jose View Post...
You must have a revolver bro
Most guns (but not all) won't allow you to pull the trigger more than once without having to racking the slide. Nothing annoys me more than when I see that shit happening....

no doubt. about a year ago a house 4 doors down from me was raided by allen pd and swat. it was around 4:30 am, i was awaken by the sound of a round discharged, sounded like a shotgun. as i grabbed the nightstand weapon and ran to my window, it was followed by 2 stun grenades (which carried a healthy concussive force that most of my street felt) then finally was followed up with a announcement on PA and finally the rest of the cars on the street flipped the red and blues.Originally posted by Baron View Postmaybe a door breaching round?
that's not a fun way to wake up, i'm surprised more people aren't killed.Last edited by momo; 12-27-2013, 03:43 PM.www.hppmotorsports.com

What a fucking total waste. No knock warrants are fucking bullshit in 99.99% of cases unless there is a violent crime in progress. I'm really surprised we don't hear about this more often. All over a couple of fucking pot plants. I would be pretty upset if that was how my life ended. I hope the homeowner is exonerated. Murder my fucking ass.

I'm still waiting for a no-knock at the wrong address and the homeowner shoots. What's the police going to do then?Originally posted by talisman View PostWhat a fucking total waste. I think the murder rap is BS, too. Did he intentionally kill someone? Debatable since in his mind it was a home invasion! I'm sure the lawyer is saying he was just trying to stop the threat. According to the Bryan-College Station Eagle, Sowders had obtained a search warrant for the residence after obtaining information that the homeowner was growing marijuana and possibly had stolen guns. The warrant was a "no-knock" warrant, meaning police could forcibly enter the residence without giving residents a chance to respond.
Sounds like they had a solid plan...

The fact that he did have drugs is what is going to fuck him in this situation. It validates the warrant. Him killing an officer is going to strengthen the very basis of what the warrant was built on. This should be an easy capital murder slam dunk for any DA worth a shit.Originally posted by GhostTX View PostI think the murder rap is BS, too. Did he intentionally kill someone?
