He absolutely deserves a brand new one, and they still should kiss his ass throughout the whole process.

His demand for a new car is reasonable IMO. He bought the car new. He knew the condition/history of the car. He put the miles on it. They destroy it and then offer a used, wrecked, multi-owner car as compensation? Give the guy an equally optioned new car and be done with it.

When this one showed up from Ford the salesman insisted that no one drive the truck but him. The truck was made ready and needed to be washed before delivery, the salesman walked through the wash bay got in the truck; started it up, put it in gear, and then his soapy shoe slipped off the clutch and the truck lurched into a concrete pole!
The customer now drives a chevy!
Lol if that's not a sign idk what would have been.

It was a service writer, secretary and a PAINTER! All of the painters guns and tools were sitting outside of the gate when he got to work the next morning. Service writer was charged, he was driving.

Period... The dealers make shit tons of money on new car sales, and they can eat the loss as far as I'm concerned. If it were just an accident then fine, I'm totally reasonable, but in this case nope! New car or lawyers, dealers choice.
well if he can afford a ZL1 Camaro then he can afford a excellent attorney and that dealer should be scared of that fact. wouldn't it ruin the reputation or would it be water under the bridge after the news of it fades away? interesting thought i guess!

Its a figure of speech, sorta of speak. When a place gets broken into, people say the place was 'robbed'. That guy went (broke into, doesn't matter how.) into a place of business after hours and took (stole) a piece of property that wasn't his and totaled it out.
    Stop being a moron cop

The car they are offering would show a previous owner before him on the title. He took his car to a dealership for service work and they totaled it. He's due a direct replacement okay -- exactly what he brought in - a car that was brand new when he got it so he knows 100% what kind of care the car has received. Since they obviously can't give him that, then they should do the next best thing -- a brand new one. Since they are trying to fuck him over and drag this thing out, then he should be compensated for it. Now, if it was a civic with 60K miles on it, then I agree he should take a car in similar condition.

Oh, and LOL at the suggestion that he should get like 5 years worth of free service/oil changes from the dealership. THEY TOTALED HIS CAR! Why in the world would he ever take it back to them. Besides, if he only put 10K miles on it in 2 years, he's not going to need much service work.

They offered a "one owner" car that had 13k miles, had new tires(in his mind indicating it had been abused to need new tires in 13k miles), and some sort of appearance mods ("non stock badges front and rear"). It also ended up actually being a two owner car that had previously been in an accident.

Mind you, they weren't actually offering to give him this car to make the situation right. The dealership claimed that since the employee didn't have their permission to be driving the car, they weren't liable. So this "deal" was to let his insurance cut him a check for the totaled car, then allow him to purchase this "equivalent" car, minus $4k as a goodwill gesture to cover badge replacement and inconvenience.

I am with others in thinking that he may be out of line expecting a brand new replacement for his 2 year old car, but the fact that they are trying to force him to make a claim on his insurance company for their fuck up would be a tough pill to swallow Whether or not their employee had permission to take it on a joyride, they are still liable for their employees actions, and should step up and take care of this. The backlash from this among the automotive community will cost them far more than taking care of this the right way would have.
