As part of my degree, I have to do a rigorous writing component. There is a professor that is big time FTP. I may discuss with her a writing that focuses on the criminal behavior of police departments and the brazen actions that fly in the face of the best interests of the citizens (and likely the Constitution). I'm a year away from doing it, so I've got some time to think about it. The idea is to get the damn thing published, but I think it would be an interesting project nonetheless and perhaps provide some legal framework for shoving their behaviors deeply down their throat.

Seizing property is actually really difficult to do. It requires a court process and a judge to decide based on the reasons for the seizure. Dont think a cop can just come and take your TV as a seizure. This FTP movement needs to get educated and chill out

State seizure laws allow for the seizure of property used in or that are a product to a felony offense. So a guy transporting 50 pounds of dope up from the border gets stopped and arrested. The vehicle was clearly used as a part of the felony offense so its subject to be seized. It was probably paid for by the criminal activity. Why is that a bad thing?

Maybe you haven't been paying attention but plenty of people have not even been charged with a crime and have "lost their TV" and a lot of other shit. That is the whole point of the conversation. That kind of falls beyond the scenarios you have described. Do you think that is right? Do you think maybe it might be you who needs to be educated? There is a reason that president Clinton had to reform the original property seizure laws in the 90s and it isn't because the police weren't abusing them.

You need to get educated and learn to read. Is a dwi a felony where they should take your car? No it's not, but the police were frothing at the mouth to steal someone's Mercedes because of a dwi. Should you lose your car because you pick up a hooker and get caught? No you shouldn't. Should you lose your house because your dumb ass kid had a whopping $40 worth of dope? No you shouldn't.

No one in this thread is saying dope runners/dealers should be able to keep their stuff if they're caught doing that, it's the people THAT AREN'T CHARGED WITH A CRIME and their shit is being taken is where the problem is, and the trivial little crimes like picking up hookers, and the $40 worth of dope someone's kid had. IMO, the only time seizure should come into play is if they can prove that the items being seized / forfeited were obtained through nefarious means (or with the proceeds of nefarious deeds). And only after reviewed / approved by a judge.
