Winning small claims is no big deal. Its the collecting that is hardly ever fruitful.

As GE mentioned, a pre-existing medical condition the driver has and knows about and is still driving could for sure be a determination for negligence and normally be covered because of so. An unforeseen medical emergency can be "grounds" for denial in the companies eyes. As GE mentioned as well, the exposure your friend gives this company by contacting the Texas department of insurance, or/and filing a lawsuit can possible get them to budge and cut a check. Sometimes you have to press the insurance companies.
Of course if he has collision coverage, he can claim it and have his insurance go through subrogation to collect the $ and try to collect his deductible as well.Allstate Insurance

That is actually true. Plus agents will try not to expose themselves to very many e&o claims, which is good. I actually carry an all lines adjuster license as well, however, I stay away from getting too involved in a claim to some extent.
