I don't believe a said the cops care. the fact is that once the asset forfeiture case is filed, all parties with an INTEREST (read lien) are served. At that point, anyone with an interest can assert their response. In the case of a lien holder , it would be an innocent owner defense. The DA's office civil section handles these. The DA will generally reject cases with an obvious innocent owner, or a lien that outweighs the value of the vehicle.
I'm just trying to enlighten you guys to the process. I never said I agreed with ALL of it, some yes. But I do have some education on the matters at which are being discussed. As for the matters I bring you facts and cite my sources. Just like the original discussion on the trailer, it was confirmed stolen. One thing many of you may not have picked up on in the TCU story is how property with liens is treated. If a bank has a note on something they shy away from trying to take it. This is because banks have armies of lawyers who routinely crucify these idiots in legal proceedings. They do their best to only steal from folks who don't have the deep pockets to fund a legal battle.

This is incorrect from what I have seen anyways. It all depends on how much is owed to the bank. They don't routinely try to screw the bank as they are not the ones that committed the felony. It comes down to what the vehicle is worth, and if the department wants to pay it off through the bank and seize it. Say a guy owns a Viper worth 40k and owes 3k on it. Department might pay it off and seize it. I have never seen a department try to seize a vehicle when bunch was owed on it. Has nothing to do with the lawyers sitting around the banks being bored, as far as I have seen.

Years ago it was figured out a bunch of gentlemen had a fake company set up that was holding a fake lien on big money cars that were paid off by people doing bad things. I think the IRS stepped in and seized the business and every car attached to it, then divided it up. Like 10 or more cars and some high end exotics. There was a article in the paper on it as all the cars were held at a local PD.

The fact of the matter is, the govt should have to provide undeniable proof and apply the same due process given to alleged criminals, if they want to seize anything.

All you are doing is offering the typical cop spin on things. When it suits your point you'll point out the letter of the law and how things should operate. That is until real world experience and how things actually work supports some other point. We have seen all of this before, no one here is going to fall for this nonsense.

Don't claim that anyone in the police department cares about innocent owners. That is a fucking lie. The innocent owner defense only works if you have a lawyer backing you up to enforce it. In fact, if you bring it up the police and the DA will start threatening you with other charges or start claiming that you are going to have to pay their legal fees if the case is decided in their favor. The ACLU has a stack of cases where that scenario has unfolded many times. As I said, most banks have lawyers sitting around with nothing to do.
