After a little more research, I gather that Derive knew about the lawsuit before the purchase of SCT/Bullydog. From what I can comprehend, it started on the 6.4 PSD tuning and the $300k ticket was part of the deal.

In otherwords, seems like it's been going on for a long time.

Wouldn't doubt that. CARB took Derive for another half mil couple years ago for stuff Bullydog sold back in 2010. It's a game they won't win, but they plan to keep playing (making money) in the mean time.
