Because Nascar did not recommend that portion of the inner wall to have the safer barrier. Since you're opening up this bag, do you also think Earnhardt Sr. should have been banned from Motorsports? There are probably 2 dozen old school NASCAR racers, including Earnhardt Sr., that admitted numerous times to wrecking someone and didn't feel a bit of remorse after the fact.
