I almost positive that you don't have to wear a seat belt while driving along the beach on sand, as long as it isn't a paved public road. However he could claim he followed you, from a paved road, and you didn't have one on then either
I know that you can even get away with letting children ride in the bed of a truck on the beach too.

Not always true sometimes they don't see it, I was pulled over for no seatbelt but I had a 5 point on. Once he saw that I was let go.
