What are the chances he grabbed his radar gun and clocked me at 51mph or something less than 5 seconds after he got back in his cruiser? It's a BS ticket. I was stupid for getting back on the throttle right past him, but I didn't violate the statute he cited me for in this case. That is the fact which is why I will fight it and hopefully get the citation dismissed.

It gets sticky in this area, because the statute says "passing". If he checked you after you passed, then its a moot point. If I do radar someone coming up from behind, I use the sideview mirror to bounce the radar off of it and check the speed as they are approaching.

Think of this, the moment you pass, even a second after at 50 mph, you are now 75 feet past the emergency vehicle. A general thumb for distance is MPH x 1.5 = distance. So, at 70 mph, you are doing about 105 feet for every second.

If he checked you at 4 seconds after you passed at 50 mph, then you are looking at about 300 feet. See how this works?

Judges can make up their own facts now? The last 1:25 of the video is superfluous to my citation. What I did after I passed him was irrelevant to the citations I got. That said, if it goes to trial, it will be a jury trial.

A judge can do whatever the hell they want. Just be warned, that video can be a double edged sword.

You better ask for a jury trial on this one and hope the prosecutor doesn't mention the distance factor. A judge will find you guilty just on the principal of how fast you must have been going to get that far ahead of the rest of the traffic.

Those other cars are clearly doing 20 under the limit, any reasonable person can see that.

At :02 look at the blue VW. Now watch at :51 and there is the blue vw again. Dude you were hauling ass, after you got past him at least. Should have jailed you for reckless driving and gave you a ticket for the stationary emergency vehicle and passing in the right lane. I donno where the judge is that you are going to try and fight this, but I know the judge where I work would laugh at you. No offense of course.

Yep, and some money to an attorney and the video will get the citation dismissed. I'm not saying it was the smartest decision, but the DPS officer heard my exhaust and chased me down to teach me a lesson. That's BS too.

I accelerated back up to the speed limit and those are the facts, ma'am.

But as you said, it doesn't matter in this case as I wasn't cited for anything but passing a stationary emergency vehicle and no front plate.

i have to agree here, if i'm not going to drop under around 45 or so i'll typically leave mine is 6th (and my is the lowly 436hp, he's got the 630hp zr1 which can probably go from a deadstop in 6th faster then most cars normally accelerate!)

You know the statute is EITHER reduce your speed by 20mph or more or vacate adjacent lane. Trust me, I was going under 50mph which is why I was in 2nd gear to get back up to speed. Traffic was running quite slow and he didn't radar me anyway. I tried to get over, but couldn't.

Also, on the lane vacate what about the other cars he nearly hits when he was pulling out to chase me down?

I was at the red light at Luna right after the video cut. I didn't want my license plate posted. He did turn on his siren though for about 4 seconds after he slammed on his brakes right behind me nearly hitting the back of my car.

I wouldn't have written you for vacate lane unless I radared you. I would have gotten you for the passing on the right once you slam on the gas after you pass though.
