I'm not condoning what the guy did in any way what so ever. I think he was wrong is attempting some BS vigilante justice. However, I do think a big part of the responsibility lies on the bikers shoulders as well. If he wasn't passing in a no passing zone none of this would have even happened. Just because you're able to get by safely doesn't mean that you can skirt the law to do so.
To be unbiased and honest the DA should charge the rider with crossing a double yellow line and passing in a no passing zone.

Oh, and I also am willing to bet that the old guy's insurance is going to initially try and deny any claim by the biker because he was passing illegally, and it looks like he doesn't have his MC endorsement. That's why I think he and his woman will have to sue to get paid.

Both the driver of the car and the motorcycle dude are at fault. The majority of the blame is rightfully on the old man in the car.
IMO, That "I don't care" comment is gonna' come back and bite him in the ass.

Were his story true, the first thing most people would have said is "I didn't even see him, I got stung and jerked the wheel, is he ok?" Or something to that effect. This guy was immediately defensive. "I don't care, he shouldn't have been passing in a no passing zone.."
All that said, it is difficult to prove intent beyond a reasonable doubt, so the DA will probably offer a plea to failing to maintain lane or some shit, get slapped probation and a fine (mainly due to his age), and then the biker and passenger will sue the shit out of him / his insurance.
