When the recording started she was too close for comfort in my opinion. She was on the sidewalk, which is what three maybe four feet from the road. I have no idea what she said prior to the start of the video. But she seemed a little passive aggressive. Should she have been arrested, eh probably not. However, in Texas there is a law against interfering with public duties. Penal Code 38.15 if you care to look it up.
With that said, I would not have let her get that close to the traffic stop to begin with. She should have gone inside and continued filming. Hell stand in your doorway with the door open and film.
There were several red flags in the video and I will admit I am assuming a few things here:
He stopped in front of a friends house. The friend comes outside and according to the officer says something that made him fear for his safety. The friend gets too close to the vehicle, driver and officers.
Like I said I assumed a couple of things from what I saw on the video. But I will say this, you let people get that close and bad things can happen. Example: the wife of guy you are arresting for beating her ass follows you outside and decides to jump on your back because she doesn't want her husband to go to jail. Even though this is the third time you've been called to the house and every time she is bleeding. Been there, done that.
I am sure I will take a bashing for somewhat supporting the officer, but oh well.

glad to see that you are an expert in civil law as well as ticket writing. Good to have a backup plan!Originally posted by Machx2 View PostI don't think she will get anything out of this. The charges may be dropped but she didn't get beat or anything so I doubt she will get any money.

Are you serious? Go search on youtube for "police brutality". Id say there is more than enough instances in the news and elsewhere, and that's just the shit caught on tape. Imagine how much other shit happens and there's no proof. Its to help keep them accountable for their actions, which IMO needs to be done. You think a cop is less likely to break the law if he is on camera? I would think more often than not, the answer is yes. Like the cops say to us, "if you have nothing to hide, then there is nothing to worry about",Originally posted by 347Mike View Post
What the fuck is the point in video taping the police anyways? I see a lot of these videos circling. It is sort of like when you are a kid and your brother asks you to stop touching him so you put your finger real close to his face and say I am not touching you.
Just seems dumb..

Lets see, she has to go to jail, post bond $, pay a lawyer $$ and have a criminal arrest on her record for the rest of her life.Originally posted by Machx2 View PostI believe firing is enough. He won't work in another Police field again if he does. So that ruins someones whole life. If he has a criminal justice degree ect. then you are f'ed. He didn't arrest her on something she didn't do. He just went about the whole situation in the wrong way. I would have ignored her and just taken my time on the stop. She would have gotten bored and went inside. He is an idiot and the girl was a pest.
He gets a paid vacation until the investigation is done, then a reprimand or at worst fired from a job that only takes 45 credit-hours with a minimum of a 2.0 gpa.
Considering your occupation, we can see why you have that opinion.

That's fine too, but that is a risk I wouldn't feel comfortable taking. It is a what if situation. All you need is a judge who doesn't see eye to eye with you or is having a pissy day to not side with you and you spent even more time and money for nothing.Originally posted by Broncojohnny View PostWhen she is done settling with the city I bet it is worth it.

When she is done settling with the city I bet it is worth it.Originally posted by 347Mike View PostWhile I agree it is there right is it really worth being arrested and wasted countless hours and possibly have something on your record?
I would've just asked for his badge number and escalated it. If that is effect or not, who knows, but sleeping in my bed and having a clean record is more important than some useless video and 3 minutes of possible entertainment.

I agreeOriginally posted by Broncojohnny View PostIf someone has the right to do something in their front yard then they also have the right to do something in their front yard with the police doing a traffic stop in their street as long as they maintain a reasonable distance.
I really don't see what is so hard to understand about that.

True, the asshats that try to ellicit a response and then get what they asked for and whine about it need to knock it off.Originally posted by Trip McNeely View PostI wasn't talking about this particular situation. Obviously the cop was in the wrong on this. I was making a general statement that sometimes these videographers go out of there way and element to make a point that really isnt there. That isnt the case here.

He also said that what she said to them before she started recording is what made him fear his safety or made him think the anti police thing. So that could have been anything. However he still went about it the wrong way. Was probably her bf getting arrested and she was upset.Originally posted by stevo View PostActually. he told her to go inside her house, he never said anything about wanting her to stand on the porch. I imagine if she was filming from the window, he would have been beating on her door.
He also cops a fucking attitude right off by saying "you seem to be very, uhhh, anti-police so I don't feel safe with you standing behind me". How is she being 'very anti-police', by standing in her yard holding a camera?
In instances like this, just firing the prick isn't enough, if the woman has to go to jail for factious charges, the cop needs to go to jail for a minimum of the same amount of time, then be forced to pay the same amounts for bail/time work time lost, etc. If these guys were held responsible for their actions, this type of shit wouldn't happen. Instead, he'll get a paid vacation until his cronies decide what to do, then reprimanded, or fired at worse.
Same ol' shit.
