If there is a warrant with the same name, or a SOUNDEX hit, then the SSN is used to confirm or deny that it is the correct person.

For all of you that would refuse to give it, you're just giving the officer a reason to haul you in and have you fingerprinted. All the while your car is towed.

    Oh noes, the Commish!!!!

Seriously, if you play the name game, then expect to be fingerprinted....

Gee, you are killing me. I haven't had one single complaint in 20 years.

I guess some agencies could, like Luis said, have a blank on the form, but I personally would not ask unless there was a close SOUNDEX hit on the person and that person did not have valid DL or ID.

Most of the times it is someone who claims to have no DL or ID and they try to play the name game.

IMHO, there is NO reason to accumulate SSNs. Even our reporting system has a place for SSN, but I have never asked and I have never put it in a report.

If you have a valid DL and you are getting stopped for traffic violations only, I wouldn't give mine out either.

Sec. 38.02. FAILURE TO IDENTIFY. (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information.
    (b) A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has: (1) lawfully arrested the person;(2) lawfully detained the person; or(3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense.
    (c) Except as provided by Subsections (d) and (e), an offense under this section is: (1) a Class C misdemeanor if the offense is committed under Subsection (a); or(2) a Class B misdemeanor if the offense is committed under Subsection (b).
    (d) If it is shown on the trial of an offense under this section that the defendant was a fugitive from justice at the time of the offense, the offense is: (1) a Class B misdemeanor if the offense is committed under Subsection (a); or(2) a Class A misdemeanor if the offense is committed under Subsection (b).
    (e) If conduct that constitutes an offense under this section also constitutes an offense under Section 106.07, Alcoholic Beverage Code, the actor may be prosecuted only under Section 106.07.

Do you see SSN in that statute?

    I don't either.

So, what's your next stupid question?

Next time read the whole thread before you start calling someone out.

Let me spell it out for you.

If someone claims to have no ID, and the info comes back with a SOUNDEX hit and the physical characteristics are similar, the officer has enough reason to take you down and get you printed.

    Simple enough?

I never said that an officer has reason to take you on the sole reason of not providing a SSN.

There are a ton of scenarios, but I like the way you stay out of a conversation and lurk until you find a way to make a stab.

How about some constructive input instead of these hit and run tactics?

I've quoted all of my posts so anyone with a brain can see where this started and that I predicated my information with the word "if"....

It's easy to tell the FTP'ers took the tangent and tried to twist and shape my posts down the slippery slope, but in the end, they just refuse to get it.

Simply put, the SSN is not the "end all, be all" of identification. It is not mandatory that you provide it (see Ch. 38). The only scenario I can think of that it is used is for warrant hit identification, and I've already posted that it would not be necessary unless the person stopped did not have ID or the other identifiers present were a possible match.

MattB, Nash, Alan, say what you want, but in the end, this is just another bitch session.

I was under the impression the cop already had that info on his data computer and would merely be verifying it against what the driver said. I have no idea what those little computers bring up on the screen during a traffic stop.

My comment of "thinking dumber" was purely stating your procedures have to account for every dumbass under the sun and still consider legal ramifications. Can't just be a simple write the ticket and move on like it used to.

Have you ever had your info stolen on the net before? Reason I ask is cause a hit will pop up asking for ss or "password" for people that have had their credit info stolen.

Saying two things that contradict each other isn't the basis for a logical argument. Just saying!
