In Texas 13 and younger is considered a child, screwing a girl 14 to 16 is a different charge than screwing one that is 13 or younger. The defense pointed out in their closing arguments that the laws against child pronography were written so vaguely that the movie Titanic under the letter of the law is child pronography. The prosecution acknowledged that the movie Titanic is child pronography but said that they had prosecutorial discretion in prosecuting the charge.

A person post puberty is not a child. ( by the way, the courts completely agree with me on this subject because we prosecute people as young as 12 for criminal offenses in adult courts and send them to adult prisons once they turn 17.) I'm not advocating for distributing porn or allowing porn with early teenagers in it but I am advocating for having different tiers of a criminal offense depending on the age of the person in the porn.
